1. Account Registration
To use the Services, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use.
2. Use of the Services
You may use the Services only for lawful purposes and in accordance with these Terms. You agree not to: use the Services to transmit harmful, fraudulent, or illegal content; attempt to gain unauthorized access to any part of the Services; interfere with or disrupt the Services or their infrastructure; reverse-engineer, decompile, or disassemble any part of the Services; or resell or redistribute the Services without our written consent.
3. Subscriptions and Payments
Some features of the Services require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as expressly stated in our refund policy. We may change pricing with 30 days' notice. Continued use after a price change constitutes acceptance.
4. Your Data
You retain ownership of all data you upload to or create through the Services ("Your Data"). You grant us a limited license to use Your Data solely to provide and improve the Services. We will not access Your Data except as needed for service delivery, support, or as required by law. Our use of Your Data is further governed by our Privacy Policy.
5. Tenant Responsibilities
If you create a tenant account for a restaurant or business, you are responsible for all users within that tenant, their compliance with these Terms, and the accuracy of menu, pricing, and business information you publish through the Services. You are responsible for complying with applicable food safety, tax, and consumer protection laws in your jurisdiction.
6. Third-Party Integrations
The Services may integrate with third-party platforms (WhatsApp, Meta, payment processors, delivery services). Your use of these integrations is subject to the respective third party's terms and policies. We are not responsible for the availability, accuracy, or conduct of third-party services.
7. Intellectual Property
The Services, including their design, code, documentation, and branding, are owned by Zestia and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.
8. Uptime and Support
We strive to maintain high availability but do not guarantee uninterrupted service. We will provide reasonable notice of planned maintenance. Support is available per your subscription plan. Enterprise plans may include a Service Level Agreement (SLA) with specific uptime commitments.
9. Limitation of Liability
To the maximum extent permitted by law, Zestia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
You may cancel your account at any time from the dashboard. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, your right to use the Services ceases. We will make Your Data available for export for 30 days after termination, after which it may be deleted.
11. Modifications
We may update these Terms from time to time. We will notify you of material changes by email or through the Services at least 15 days before they take effect. Your continued use after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the jurisdiction in which Zestia is incorporated, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
